Stewart, of Caneyville, was operating a 1996 Oldsmobile 88 when, according to the testimony he gave the officer at the officer at the scene, he rounded a corner and then saw the horse and buggy in his lane. Stewart said he attempted to brake and avoid contact, but was unable to do so.
The passengers in the buggy, Tobies Gingrich, 45, and Ida Gingrich, 18, both also of Caneyville, relayed to Willen that Stewart’s vehicle was not travelling very quickly when it approached them, and Stewart was very nearly able to miss the buggy altogether.
