Merrifield Sentenced

Richard Scott Merrifield, 18, was sentenced in Circuit Court on Wednesday, Feb. 25, for two felony charges and one misdemeanor.

Merrifield received the maximum 10-year sentence for charges of possession of a controlled substance in the first degree (meth) and possession of drug paraphernalia.

Merrifield also received sentence of one year for possession of marijuana, a misdemeanor, which is to run concurrently with the felony charges.

Ballbat Mistrial

The charges were placed on or around May 30, 2003. Stephen Brewer and Jerry Fox stood trial for assault in the first degree Monday, Feb. 23 in Grayson County Circuit Court but was determined a mistrial.

According to previous reports in the News-Gazette, Brewer and Fox were charged with assaulting Jim Simpson with a bat on or around May 25, 2003. Simpson reportedly received serious physical injury.

Judge Robert A. Miller heard testimony from the state on the Fox case with several witnesses testifying.

When the defense attempted to submit the bat in question as evidence in the trial, the prosecution, not having prior knowledge of the evidence, made motion for a mistrial, and Miller granted the mistrial.

The bat was given to Sheriff David Simon for holding.

Another trial will be set. The date was unavailable at press time.

KSP Arrests

Larry J. Reynolds, Jr. of Caneyville was arrested for possession of marijuana.

Freddy L. Swift, Jr. of Caneyville was arrested for failure to appear warrant.

John R. Clark of Morgantown, was arrested for no registration, expired registration plate, failure to wear seatbelt-two counts, no operator's license, improper registration plate and no insurance.

James Logsdon of McDaniels, was arrested for DUI, under 21 and no insurance.

Deidre A. Williams of Louisville, was arrested for speeding and reckless driving.
