Twelve men and 6 women have been indicted in Grayson County Circuit Court in relation to thirteen separate incidents between January 1, 2006 and August 17, 2012.
Barry E. Payton, 28, of Center Street in Caneyville, was indicted on two counts of wanton endangerment in the first degree, assault in the second degree, assault in the fourth degree with a minor injury, criminal mischief in the third degree, and being a persistent felony offender in the second degree.
Payton is alleged to have exhibited “extreme indifference to the value of human life” by forcing Lori Goldsberry’s car off of the roadway on or about July 26, 2012, creating “substantial danger of death or serious physical injury to her,” according to the indictment. Damage to the vehicle was estimated at less than $500.
The same risk of death or physical injury was extended to Goldsberry’s passenger, Melinda Haynes.
Additionally, Payton is charged with causing physical injury to Haynes by “striking her with his hand and choking her.”
On the same date, Payton is accused of having intentionally caused physical injury to Clyde Cochran using as a weapon “a wooden 2 x 4.”
Having already been a convicted felon at the time of the alleged incident, Payton is additionally charged with being a persistent felony offender.
Due to the offensive nature of the accused crimes, Payton is being held on $15,000 cash bond.
Jeffery T. Tigner, 30, of Old Leitchfield Road in Clarkson, was indicted for assault in the first degree.
The allegation states that Tigner intentionally caused physical injury to William T. Basham by stabbing him with a pocket knife.
Tigner’s bond was set at $20,000 cash.
Minnie Miller, 44, of 23 Pine Haven Road in Clarkson, and Ronnie L. Miller, 50, and Danny Miller, 23, of 11 Pine Haven Road in Clarkson, were each indicted on charges of manufacturing methamphetamine, first offense, enhanced by possession of a firearm; and possession of a controlled substance in the first degree, enhanced by possession of a firearm.
According to the indictment, the Millers’ charges stem from an August 10, 2012 incident where the three allegedly manufactured methamphetamine or had in their possession the chemicals and/or equipment for manufacturing methamphetamine with the intent to do so.
The three also had in their possession finished methamphetamine.
Possession of firearms enhanced each of the charges.
Ronnie L. Miller and Minnie Miller were additionally charged with two counts each of trafficking in a controlled substance in the first degree, less than two grams of methamphetamine, enhanced by the possession of firearms.
Minnie Miller’s bond was set at $5,000 cash; Danny Miller’s was set at $10,000 cash; and Ronnie L. Miller’s bond was set at $15,000 cash.
Kristi Gibson, 31, of King Road, in Leitchfield, along with Tonia Fox, 26, of Summit Road in Clarkson, and Jeremy Payment, 34, of Fraim Street, in Leitchfield, were each indicted on charges of manufacturing methamphetamine, first offense.
The charges stem from an alleged August 17 incident in which Gibson, Fox and Payment purportedly manufactured methamphetamine or had in their possession the chemicals and/or equipment for manufacturing the illegal drug with the intent to manufacture meth.
Payment was additionally indicted on charges of possession of a controlled substance in the first degree and being a persistent felony offender in the first degree in conjunction with the same incident.
The Commonwealth recommended a $10,000 cash bond for both Gibson and Fox. Payment’s bond was set at $20,000 cash.
21-year-old Daniel Stevenson and 25-year-old Timothy Hayes are each being indicted on charges of escape in the second degree from Grayson County Detention Center, and being a persistent felony offender in the second degree.
It is alleged that Stevenson and Hayes, on or about August 12, escaped from GCDC by jumping a fence while incarcerated at the detention center.
Having already been convicted felons at the time, the men are each additionally charged with being persistent felony offenders.
Stevenson and Hayes are each being held on $20,000 cash bonds.
44-year-old Timothy D. Terry, of Vine Grove, was indicted on one charge of burglary in the first degree, four counts of unlawful taking or disposition of a firearm, theft by unlawful taking or disposition of property valued at $500 or more, possession of a firearm by a convicted felon, and being a persistent felony offender in the second degree.
The allegations represented in court documents state that Terry is accused of burglarizing the residence of Dennis Higdon on or around June 20, 2012, during which time he purportedly stole an Uplander double barrel 20 gauge shotgun, a New England .223 caliber rifle, a Thompson Center Arms .17 mach IV rifle, an Iticha 51 featherlight 12 gauge shotgun, and miscellaneous personal property with a minimal value of at least $500.
Having already been a convicted felon at the time of the incident, Terry is also accused of being a persistent felony offender and possession of a firearm by a convicted felon.
Due to the offensive nature of these crimes, Terry is being held on a $50,000 cash bond.
Co-defendants in Terry’s case are Michael S. Acord and James G. Parrett.
Noah Nevil, 38, of Falls of Rough, was indicted for burglary in the second degree and theft by unlawful taking or disposition of property valued at under $500.
The charges stem from an allegation that Nevil entered a residence belonging to Steve Jones for the purpose of committing a crime and that he took a plow, post hole digger, hand tools and power tools all belonging to Jones. The alleged crime occurred on July 25, 2012.
The combined value of the items listed as stolen is estimated at less than $500.
Nevil is not being held on bond, but must abide by a curfew.
Keith Paris, 39, of Sunrise Drive in Leitchfield, has also been indicted on charges of burglary in the second degree and theft by unlawful taking or disposition of property valued at under $500.
According to court documents, Paris is accused of entering the residence of Kim Coleman on or about July 8, 2012, and of having taken methadone pills belonging to Coleman.
The value of the medication purported to have been stolen is estimated at less than $500.
The Commonwealth recommended a bond of $10,000 for Paris.
Elizabeth L. Alvey was indicted on a charge of Knowing Exploitation of an Adult Over $300.
The alleged incident occurred between January 1, 2006 and January 3, 2012, when Alvey “knowingly exploited Bettye B. Watkins, an adult, resulting in a loss… of more than $300 in financial or other resources, or both,” according to court documentation.
Tanya Kwaitkowski, 30, of Bonnieville, was indicted for flagrant non-support.
Kwaitkowski is purported to have persistently failed to provide child support for her two minor children, ages 7 and 5. Documentation alleges that as of August 28, 2012, Kwaitkowski owed arrearage of $5,367.14 in addition to a current support obligation of $298.50 per month.
Kwaitkowski is being held on $10,000 bond, 50 percent of which must be cash and is non-refundable to the extent of child support arrearage.
Domoni Moffett, 35, has been indicted for flagrant non-support.
Moffett is alleged to have persistently failed to provide child support for her minor child, aged 9. As of August 23, 2012, Moffett purportedly owed an arrearage of $1,930.76 in addition to her current child support obligation of $255.98 per month.
Moffett is being held on a $10,000 bond, 50 percent of which must be cash and is non-refundable to the extent of child support arrearage.
Terry Lawson, 51, of Owensboro Road in Leitchfield, was indicted for flagrant non-support.
Lawson is alleged to have persistently failed to provide child support for one minor child, aged 11.
Court documentation alleges that Lawson owed an arrearage of $5,834.23 as of July 31, 2012 in addition to his regular monthly obligation of $274.82.
A bond of $10,000, 60 percent of which must be cash, and is non-refundable to the extent of child support arrearage was recommended for Lawson.
Robert N. Tonge, 46, of Fraim Street in Leitchfield, was indicted on a charge of providing a false statement or misrepresentation to receive benefits over $100.
Tonge is accused of committing the offense between September 2010 and February 2012 when he, acting either alone or in complicity with others, falsely stated or misrepresented his household income for the purpose of receiving food stamps and Medicaid benefits.
The total value of benefits received as a result of the misinformation was greater than $100.
