EAST ALTON — An East Alton man is facing a criminal sexual assault charge for allegedly performing a sexual act with a female who was unable to give her consent.
Authorities said Jacob M. Hyden, 18, of the 100 block of Ohio Avenue, performed a sexual act on the victim, a minor, while she was unconscious. Police declined to say why the victim was unconscious. The charge does not include the fact that the victim was a minor but that she was unable to give her consent.
Hyden allegedly sought the victim out and committed the act on Nov. 24 2012.
The case had taken until Friday to charge because it has taken that long to send away DNA samples and obtain the results.
Police said they have taken statements from both the victim and the suspect.
Hyden was arrested over the weekend and is in the Madison County Jail in lieu of $500,000 bail. Bond would be 10 percent, or $50,000.
In addition to the charge the state has filed for, and obtained, an order for additional conditions of bail bond. The motion c0ntends the suspect has previously threatened or perpetrated physical abuse toward the victim and allegedly presents a continued threat to the victim and that he may harm, harass, or interfere with her personal liberty while the case is pending.
A judge signed an order for Hyden to have no contact with the victim and to remain at least 1,500 feet away from her.
Hyden has a previous conviction for fighting and battery, both Wood River city ordinance violations. The battery charge alleged he hit a woman in the back of the head. He was placed on supervision in each case.
